Any and all features, content, code or programming that augments, changes or enhances the Services, shall be subject to the Terms of Service. You agree that the Services is provided "AS-IS" and that Trayaan assumes no responsibility for any losses you incur as a result of failure on our part to make available any of the properties or services contemplated by these Terms and Conditions, whether now in service or a future feature, service or property.

The content that is created or owned by Trayaan and also the content that is licensed to Trayaan, such as text, graphics, images, pictures and any other media or content on the Services (hereby collectively termed as the "Content"), any scripts, codes, software or any other programs used to help or facilitate the functioning or features of our Services (hereby collectively termed as the "Site Infrastructure") (and "Content" and "Site Infrastructure" are hereinafter collectively termed as the "Site Material") are protected by copyright laws. Unless otherwise mentioned, our Site Material is copyrighted material.

Trayaan hereby grants you a limited, revocable, non-exclusive, non-assignable and non-transferable Licence to access the Services provided and expressly conditioned upon your agreement that all such access and use shall be governed by all of the terms and conditions set forth in this User Agreement.
Licence to use Trayaan: Trayaan is intended solely for your personal and non-commercial use. You may view, download for caching and purely personal viewing purposes only, and print pages from the Services, provided that:1. TRAYAAN DOES NOT WARRANT THAT THE SERVICES WILL OPERATE ERROR-FREE OR THAT THE SERVICE AND ITS SERVERS OR ANY SERVERS THROUGH WHICH IT MAY BE SERVED ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MATERIAL. IF YOUR USE OF THE SERVICES OR SITE MATERIAL RESULTS IN ANY COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, TRAYAAN SHALL NOT BE RESPONSIBLE FOR THOSE COSTS OR EXPENSES.
THE SERVICE AND ITS MATERIAL ARE PROVIDED ON AN "AS IS" AND "AT YOUR OWN RISK" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TRAYAAN, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES RIGHTS, AND THE WARRANTY OF FITNESS FOR PARTICULAR PURPOSE. ALTHOUGH TRAYAAN STRIVES TO PROVIDE THOROUGH AND ACCURATE MATERIALS ON THE SERVICES, WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE MATERIAL, SERVICES, SOFTWARE, TEXT, IMAGES, GRAPHICS, AND LINKS.
6. Disclaimer of Consequential Damages
IN NO EVENT SHALL TRAYAAN, ITS OWNERS, MANAGERS, AUTHORS, ASSOCIATES, SUPPLIERS, AFFILIATES, CONTENT PROVIDERS, AND LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE MATERIAL ON THE SERVICES OR WEBSITES LINKED TO THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TRAYAAN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Indemnity
By using the Services, you agree to defend, indemnify, and hold harmless Trayaan, its owners, officers, directors, managers, employees and agents, from and against any and all losses, claims, damages, costs and expenses (including reasonable legal and accounting fees) that Trayaan may become obligated to pay arising or resulting from your use of the Site Material or your breach of these Terms and Conditions. Trayaan reserves the right to assume or participate, at your expense, in the investigation, settlement and defence of any such action or claim.
8. Advertisements
Trayaan may run advertisements and promotions from third parties on the Services.
The advertisements or promotions on Trayaan are served dynamically by third-parties through advertising networks or platforms which serve ads that are entirely programmatically selected to be displayed on the Services, and we may earn a commission through the advertisements, (hereinafter collectively termed as the “Advertisement” or “Advertisements”). Trayaan is not responsible for any errors, omissions or representations in the Advertisements or on any of the advertiser's pages. Trayaan is not responsible for any kind of material or media or any links in the dynamically served Advertisements, any linked external websites or web pages or apps of the advertisers, and any content or materials in those advertiser's websites or apps.
Your business dealings or correspondence with, or participation in promotions of, Advertisers through the Advertisements on Trayaan, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third-parties. Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information in the Advertisements.
Trayaan is not responsible or liable for any loss or damage of any sort incurred by you as the result of any dealings between you and the advertisers or Advertisements, or as the result of the presence of third-party advertisers on the Services, or as a result of you visiting any external third-party websites or apps or third-party services through any links in Advertisements.
Advertising that appears on Trayaan may partly help us to provide the Services to you and to maintain and make the Services available. 2. We may also mention a name and provide reviews or details of places where food or drinks are served, such as, a restaurant, eatery, cafeteria, bar, or any other kind of food serving outlets (hereafter mentioned as "Places Serving Food").
3. We may also mention a name and provide reviews or details of places that provide recreation or entertainment activities like sports, cinema, or any other places that provide recreational or entertainment activities (hereafter mentioned as "Places of Recreation").
4. We may also mention the modes of travel we took when we travelled. We aim to keep the information we provide accurate, as far as rationally possible, but there are chances of errors or discrepancies in the information, or chances of information getting outdated with the passage of time.

Trayaan does not accept or consider any unsolicited ideas or materials, including, but not limited to, content, themes, articles, stories, experiences, tips, promotions, advertising, new products, tools, technology, new features, new sections, or any other kind of ideas or suggestions that that are unsolicited. Please do not send any original ideas, materials, or samples to us. This declaration is to avoid any misunderstandings or disputes in case any of Trayaan's contents, products, or strategies might seem similar to unsolicited ideas submitted to us. Any similarity between an unsolicited submission and any product or Site Material on Trayaan, or any strategy or operations by Trayaan, is purely coincidental. Despite this request that you should not send us unsolicited ideas or materials, if you still choose to send them to us, Trayaan cannot and does not guarantee that unsolicited ideas or materials will be regarded as confidential or proprietary and may use it in accordance with the terms in the section 12.2 below for Submitted Information. By sending an unsolicited submission you waive the right to make any claim against Trayaan or its associates or affiliates relating to any unsolicited submissions by you.

Trayaan welcomes your comments and feedback on our website; however, you acknowledge that if you send us creative suggestions, ideas, recipes, notes, drawings, concepts, experiences, inventions or other information, (collectively, the "Submitted Information"), all Submitted Information shall be deemed, and shall remain the property of Trayaan. This applies to all the comments or feedback which may be sent through both the comment boards (which is publicly accessible) as well as the contact forms or feedback forms (which is submitted privately to us). By submission of any information to us, you assign to us and we shall own exclusively all rights to such Submitted Information of every kind and nature.

14.1. Commenting Guidelines
Users are advised to read our Comment Policy before commenting. The conditions for Commenting on Trayaan are that: You must not restrict or inhibit any other user from using the comment forms. You must not post or transmit any unlawful, threatening, abusive, libellous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any local, state, national or international law. You must not post or publish any comment or material that includes any personally identifiable information about any individual, whether it belongs to yourself or any other individual. Every comment entered on Trayaan will be moderated. Any forms of hate-speech, indecent remarks, and any unlawful, threatening, abusive, libellous, defamatory, obscene, vulgar, pornographic, profane comments, or any comments that violate these Commenting Guidelines, or any comments that Trayaan deems inappropriate, will be moderated or completely deleted at the sole discretion of Trayaan. Also, comments made with a fake/false i.d. or comments posted as impersonating any of the Authors at Trayaan or any other visitor or user, will be removed. We try our best to keep our comment sections free of abusive and derogatory comments but we cannot guarantee a 100% effective moderation at all times.

None of the provisions of these Terms and Conditions constitute any kind of partnership between you and Trayaan. The provisions of these Terms and Conditions do not give you any authority to bind Trayaan in any manner whatsoever.
Our failure to enforce any provision or to respond to a breach of these Terms of Service does not in any way constitute a waiver of our right to subsequently enforce the terms or take action on similar breaches later on.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
